The enforcement of court judgments in France

The main core of the law applicable in France on the channels of enforcement is the outcome of the reform introduced by a law of 9 July 1991. Under article 1 of the law, any creditor may, in the circumstances envisaged by the law, force a defaulting debtor to fulfil his obligations towards the creditor. According to article 2 of the above-mentionned law, a creditor who possesses an enforceable right establishing a claim for a debt that is fixed and due can carry out the enforcement on the debtor’s assets according to the conditions for each enforcement measure.
